TRADES & BUILDERS BUSINESS COACHING TERMS AND CONDITIONS

These terms and conditions (hereinafter “Terms”) govern Your use of the following program (which is hereinafter referred to as “T&BBC”): BusinessSight (Vic) Pty Ltd (hereinafter rereferred to Us, BusinessSight or the Provider)

The T&BBC is owned and operated by: BusinessSight (Vic) Pty Ltd and these Terms constitute a binding contract between You and: BusinessSight (Vic) Pty Ltd.

1. YOUR AGREEMENT AND REPRESENTATIONS

a. In connection with your use of the T&BBC, we may also provide You with access to various other content, documentation, materials, information, goods, or services. In these Terms, we refer to all of these items collectively as “the Items”. These Terms will govern Your use of all pages of the T&BBC, as well as Your use of the Items

b. you, are defined as the person that Ticked the Box “I agree to the Terms and Conditions” on the order service options/ summary page, giving your consent and to personally abide by this agreement.

c. By continuing to use the T&BBC and the Items You warrant and acknowledge that You have had the chance to review and consider the Terms, that You understand the Terms and that You agree to be bound by the Terms. If You do not understand the Terms or do not agree to be bound by them then you must stop using the Items immediately. We only agree to provide use of the Items to You if You agree to these Terms.

d. By continuing to use the T&BBC and the Items You represent and warrant to Us that You have legal capacity to enter these Terms.

e By continuing to use the T&BBC and the Items You represent and warrant to Us that You have complied with all these Terms.

d. If You continue to use the T&BBC, You acknowledge that You have been given the chance to review the Terms. You acknowledge that You understand the Terms and that You agree to be bound by the Terms.

2. LICENCE TO USE PRODUCT, CONTENT AND MATERIALS

a. We may provide You with certain other Items in connection with Your use of the T&BBC.

b. Subject to these Terms, We grant You a licence to use the Product, Content and Materials solely in connection with Your use of the Items. The licence created under these Terms is non-exclusive, limited, non-transferable, worldwide, and revocable.

3. SALE OF GOODS/SERVICES

a. We may sell Services or may allow third parties to sell Services on the Product. If this occurs, then some specific exclusions of liability will apply, as described in the “Exclusion of Liability” clause.

4. EXCLUSION OF LIABILITY

a. The T&BBC, Content and Materials are provided for general information only and may change at any time without prior notice.

b. You accept and acknowledge that the Items may contain mistakes, errors, and inaccuracies.

c Your use of the T&BBC, Content and Materials is entirely at Your risk. It is Your responsibility to make sure that any Goods, Services, Materials, Content, or other information available through the T&BBC suits Your particular purpose.

d. Neither We, nor any third parties, provide any guarantees or warranties regarding the accuracy, completeness, performance, reliability, timeliness, quality, merchantability, safety, legality, or suitability for a particular purpose of the Items.

e. To the maximum extent permitted by law, We hereby expressly exclude all warranties, guarantees, representations or terms (whether express or implied) except for those expressly set out in these Terms.

f. To the maximum extent permitted by law, We hereby expressly exclude any liability in relation to the accuracy, completeness, performance, reliability, timeliness, quality, merchantability, safety, legality, or suitability for a particular purpose of the Items.

g. To the maximum extent permitted by law, We hereby expressly exclude any liability in relation to loss of data, interruption to Your business or any damages which are incidental to or arise from such loss of data or interruption to business.

h. To the maximum extent permitted by law, We will not be liable for any damage, loss, cost, or expense including legal costs and expenses, whether direct or indirect, incurred by You in connection with Your use of the Items.

5. INDEMNITY

You hereby indemnify Us (which, for the sake of clarity, also includes any of our employees, affiliates, agents, or other representatives) and You agree to defend Us and to hold Us harmless in relation to any and all claims, suits, demands, actions, liabilities, costs, and expenses (including legal costs and expenses on a full indemnity basis) which may arise from or relate to Your use or misuse of the Items. You agree that We may select Our own legal representation and may participate in Our own legal proceedings if We choose.

6. TERMINATION

We may immediately terminate these Terms at any time, with or without cause.

7. VARIATION OF TERMS

a. You hereby acknowledge and agree that these Terms may be varied or amended from time to time in Our sole discretion. If You continue to use the T&BBC following any such variation or amendment You will be deemed to have confirmed and agreed to the new Terms as varied or amended.

8. INTELLECTUAL PROPERTY

a. The Items contain intellectual property that is owned by Us and/or that is licensed to Us. This includes, but is not limited to, the contents, layout, design, colours, appearance, graphics and imagery of the Product, Content, Materials and Goods as well as all copyrights, trademarks, trade secrets, patents and other intellectual property contained in the Items (hereinafter “Company IP”).

b. You hereby acknowledge and agree that, as between Us and You, We own all intellectual property rights in the Items and that nothing in these Terms amounts to a transfer of any intellectual property rights from Us to You.

c. You hereby acknowledge and agree not to use the Company IP for any unlawful or infringing purpose.

9. REVERSE ENGINEERING AND SECURITY

You agree not to:
a. reverse engineer, or attempt to reverse engineer or disassemble any code or software from or on the Items; and

b. violate the security of the Items through any unauthorised access, circumvention of encryption or other security tools, data mining or interference with any host, user, or network.

10. GENERAL PROVISIONS

a. Australian Consumer Law: You may have certain rights, warranties, guarantees and remedies under the Australian Consumer Law, which is contained in the Competition and Consumer Act 2010 (Cth), and these rights, warranties, guarantees and remedies may not be restricted, modified, or excluded by Us. Our liability to you is governed solely by these Terms and the Australian Consumer Law.

b. Applicable law: Your use of the T&BBC and the Items is subject to the laws of Victoria, Australia and each party submits to the jurisdiction of the courts of Victoria, Australia.

d. No assignment: You must not assign, sub-licence or otherwise deal in any way with your rights under these Terms without Our prior written consent.

e. Separate agreements: You may have other legal agreements with Us. Those other legal agreements are separate from and are in addition to these Terms. These Terms do not alter, amend, revise, or replace the terms of any other legal agreements You may have with Us.

10. 28 DAY GUARANTEE

a. From the day you sign up you have you have 28 days to leave: If you feel that the T&BBC will not provide you with the tools, resources and support to get what your wrote in your response to your onboarding questions, you can send an email to support@businesssight.com stating why you joined the T&BBC and what you believe you are not getting

b. Reviewed: Your response will be reviewed, with us looking at the reason why your applied and what your response is

d. Cancellation: If your term with BusinessSight is cancelled you will lose the first month’s payment, and your direct debit will be cancelled so long as the request is approved and received to our office within 28 days or less

e. Reply Period: For a successful application of termination of the agreement, you must provide your written response to us at support@businesssight.com no later than 28 days of your initial date of application

f. After 28 days; The 28 Day Guarantee will have lapsed

g. After the 28-day period has lapsed, You are personally liable for the full term of the 12 months or balance owing of the level of The Trades and Builders Business Coaching You, have signed for

H. There are no refunds after the 28-day guarantee

THE PREWORK: You will get an email with some questions so we can understand where you are at and a routine to set up so you can make progress straight away

A BETTER OFFICE STRUCTURE: As we grow our business so does the tasks in the office, the goal would be to create a structure that can allocate the tasks to the right people and put the right processes in place, we have a process that we designed that will set you up with A Better Office Structure, this will give you some recommendations on what to do and in what order.

IMPROVE YOUR PEOPLE: Get taken through what is required so you can build the Team you need and how to attract the new team members

GET GROWTH: Work through different marketing strategies for both in and out bound channels

BUILD SALES: Improve your sales and sales processes for you and your team

AS A LEADER: With 12 months of 1 on 1 coaching you can see some big improvements in yourself and your business

LIBRARY:
Get your very own set of business manuals covering every aspect in business, all the hard work has been done for your, this will include templates plans, checklist, and formulas on how to build a better business

BUILD A MUCH-NEEDED RHYTHM & ROUTINE: We set up a regular day and time to meet each week via zoom for us to work on, as you get better in business you will realise it’s not the amount of time, it is the way the information is structured and delivered that can make things move faster, we have set up various business tools to support your on you journey.

c. What you will get for the APEX LEVEL

As we build our Trades business we realise that time is the most important thing we have and we need to use it better, with the APEX level we have created business tools and structures for you to speed up the way you can improve you and your business and grow with a lot of the hard work being taken out and of course, we will show you how to get out of you own way so your business can grow.

FROM THE BELOW: You will get points, 1,2, 3,4, 5,9, 10 & 11, Points 6,7&8 can be included based on what you and your business needs and also the time and the work load over the 12-Month term

BUSINESS ASSESSMENT: We will take you through an extensive business assessment, so we know exactly where you are at and what you need to work on and in what order

RE DESIGN TO SCALE: After you complete the 300-point business assessment, we will work with you to redesign your business model and get rid of any blockages

GET A PERSONALISED PATH BUILT: We will create a personalised path for you as the leader and for your business, this will be derived from the Business Assessment, the phone calls, the meetings, either in person or video calls,

GROW AS A LEADER: With certainty as we profile you with our Profiling process for Trades, this will show you exactly what you must do and what you must stop doing and what type of person you need to support your grow your business

GET AN EXIT STRATEGY: We will work with you on building a clear exit strategy

SET UP A PERFORMANCE BASED BONUS: We will work with you to set areas in your business to be measured on so your team can earn more so long as the business overachieves and both you and you team win, we will set you up with and online platform already made for a trade business,

FINANCIAL MODEL: We will review your financial model and metrics plus we will supply you with the below for you and show you how to use each version, so it benefits your business:
a. Advanced Wage Calculator: so, you know who is costing you what
b. Marketing Lead Calculator: This will help you create a defined budget so you can plan and not overspend
c. Compressive Back costing Calculator: Understand where you can improve
d. The Full Financial Model: This will show you how the financials need to be structured
e. *A Performance Based Bonus System: set up for your business to get results

CREATE THE RIGHT PEOPLE STRUCTURE
A lot of Trades and Building business struggle with either finding or keeping great team members here you will be provided with the documentation and structure you need to build your Internal Team, from hiring to keeping the team and showing how we have helped others maintain a great team
Not only will we profile you, we will also profile your team, this will enable us to show you the gaps in the team that are preventing you from growing and building a better business and what steps you need to take to build a high performing team

THE ROUTINE: We will meet online once a week via zoom, plus you can message us on messenger any question you might have in-between

PLUS, EVERY QUARTER: We will review progress made to date and what gaps we have found that need to be addressed and how and what to do about them

YOUR PRIORITIES Find out how we will work with you so you can get what is important to you sooner

12. THE TRADES & BUILDERS BUSINESS COACHING PROGRAM
a. Provides one on one business educational coaching, any or all support is outlined on the Order Summary page
b. Execution: of all or any work to improve the business and or the knowledge of the person/s running the business is the responsibility of the participants attending the program
c. The term you have signed up for is for a 12-month term, In the 12-month term you will get 48 coaching sessions, the four weeks or sessions that are not provided are one week around Easter, the last week in September and the last of December and the first week of January
d. If you, the client requires additional work outside of what is mentioned for the level that have signed up for, you need to provide what you require in writing to support@businesssight.com and we will provide your with a quote for work outside this agreement

13. RECRUITMENT SUPPORT
a. If you’re the participant request one on one support for hiring a team member, employee of any sort, we will prove you with a quote prior to any work commencing as this is not part of the program
b. Work carried out: The quote will explain what BusinessSight will carry out and what you the participant will need to provide and or do

14. SUPPORT
a. If you the participant request support of any sort from us, you cannot request any more support until the work required for that first item has been completed in full
